Lien Law Summary

Who May Claim:

Prime, Subs and Material suppliers

Required Notice and Timing:

Subs, Subs-Subs, and Material suppliers must serve Prime and Owner with a NOTICE OF FURNISHING within 21 Days work first work. (if Sub/Supplier have direct contract with Prime only owner needs to be served with NOTICE OF FURNISHING) Subs/Suppliers direct contract with owner do not need to notice.

Lien Filing:

Residential – lien must be filed within 60 days of last work and served to owner within 30 days Oil/Gas – 120 days from last work – served within 30 days to owner as well as the purchaser or pipeline carrier RailRoads: 40 days from last work – served to owner

All other Commercial:

75 days from last work – served to owner 30 days (copy can be posted on the property of the owner cannot be found).

Suit Filing:

60 days  from the notice to commence suit not later than 6 years after filing the lien.

Public/Federal:

Lien on public funds within 120 days of last furnish/90 days after acceptance of the project by the public entity.

Suit Filing:

Lien on public funds filed within 60 days of the mailing of notice to the lien holder Suit on the payment bond filed NO earlier than 60 days after the notice to surety.
