Timeframe to record Lien/Bond claim:

Private Work

Original Contractors must file lien within earlier of 90 days of project completion or 60 days of Notice of Completion or Cessation. Other contractors/suppliers must file within earlier of 90 days of project completion or 30 days of Notice of Completion of Cessation. Notice of Mechanics Lien must be served to owner prior to filing lien claim.

Public Work

Must file a Stop Notice within the earlier of: (a) 30 days from the recording of a “Notice of Completion” for the project; of (b) If this notice is not recorded, within 90 days from the actual completion.

 

Timeframe to file Foreclosure Lawsuit on Lien/Bond claim:

Must file suit against the surety if claim remains unpaid, and suit must be brought no later than 6 months from the expiration of the Stop Notice period.

Comments

Can file bond claim without preliminary; 15 days after recorded notice of completion or if none, 75 days after completion.
